Marriage law · After marriageNRI Divorce in India: Jurisdiction, Foreign Decrees, Help
When one spouse lives abroad, a divorce raises extra questions: which country's court, whether a foreign decree is valid in India, and what help exists for a spouse left behind.
Where can the case be filed?
For a Hindu marriage, section 19 of the Hindu Marriage Act, 1955 lets a petition be filed in the court within whose limits:
- the marriage was solemnised;
- the respondent lives;
- the couple last lived together;
- the wife lives on the date of filing, where she is the petitioner; or
- the petitioner lives, where the respondent lives outside India or has not been heard of for seven years.
So a spouse living in India can usually file in India even if the other spouse is abroad. Courts now commonly allow appearance by video conferencing, and a spouse abroad can act through a power of attorney for some steps, though personal statements are usually still needed in a mutual consent divorce.
Is a foreign divorce valid in India?
A divorce granted abroad is not automatically valid here. Section 13 of the Code of Civil Procedure, 1908 says a foreign judgment is not conclusive where, among other things, it was not given by a court of competent jurisdiction, was not given on the merits, was obtained by fraud, breached natural justice, or was founded on a breach of Indian law.
In Y. Narasimha Rao v. Y. Venkata Lakshmi (1991), the Supreme Court held that a foreign matrimonial decree will be recognised in India only if the foreign court's jurisdiction and the ground for divorce are both recognised by the law under which the parties married. In broad terms, a foreign decree is likely to be recognised where:
- the respondent lived in that country and voluntarily and effectively took part in the case; or
- the respondent consented to the decree; and
- the ground for divorce is one available under the Indian law that governs the marriage.
An ex parte decree from a court where the husband had only technically resided, on a ground unknown to Indian law, was held not binding. The Supreme Court reaffirmed this approach in later cases.
If your spouse has obtained a foreign decree you did not take part in, get advice before assuming you are divorced, and before either of you remarries.
Help for spouses abandoned by an NRI partner
- NCW NRI Cell: the National Commission for Women is the national coordinating agency for complaints from Indian women deserted by overseas Indian husbands. It receives complaints, offers conciliation and coordinates with Indian missions, state governments and police.
- Ministry of External Affairs: MEA publishes guidance on marital issues with overseas Indians. Through the Indian Community Welfare Fund, Indian missions can give eligible women legal and financial assistance for cases abroad, through empanelled lawyers and NGOs. Eligibility and limits are set by MEA and can change, so ask the mission or MEA for current terms.
- Indian Embassy or Consulate: can help with emergency documents, shelter information and local support organisations.
Passports and Look Out Circulars
- Passport action: under section 10(3) of the Passports Act, 1967, the passport authority can impound or revoke a passport, including where a court has issued a warrant or summons for the holder's appearance. MEA has reported revoking and impounding passports of NRI husbands in matrimonial cases.
- Look Out Circulars: in criminal cases involving cognisable offences, a Look Out Circular can be issued under Ministry of Home Affairs criteria where an accused is evading the process or likely to leave the country. Courts have also cautioned against routine LOCs in matrimonial disputes.
- Summons to an NRI respondent can be served through official channels with MEA's help.
Practical steps if you are in India and your spouse is abroad
- Keep copies of the marriage certificate, passports, visas and your spouse's foreign address and employer.
- File for maintenance and, if needed, under the Domestic Violence Act in India.
- Contact the NCW NRI Cell and, for cases abroad, the Indian mission.
