Marriage law · Before marriageMarriage with Foreign National in India: Law and Documents
An Indian can marry a foreign national in India under the Special Marriage Act, or abroad before an Indian consular officer under the Foreign Marriage Act. The foreign partner needs proof of identity and single status, and afterwards can apply for an entry visa and, later, an OCI card.
Which law to use
Marrying in India. The Special Marriage Act, 1954 is the usual route when one partner is foreign. It does not depend on religion and is recognised by most foreign governments because it produces a civil marriage certificate. If both partners are Hindu, Sikh, Jain or Buddhist, a Hindu marriage registered under the Hindu Marriage Act is also possible, but registrars often expect a foreign partner to use the Special Marriage Act, and some foreign authorities ask for a civil certificate in any case.
Marrying abroad. The Foreign Marriage Act, 1969 lets a marriage be solemnised outside India before an Indian Marriage Officer (a diplomatic or consular officer) where at least one partner is an Indian citizen. It has its own notice and residence requirements, so check with the Indian mission in that country. Many couples instead marry under the local law of the foreign country and then rely on that certificate, apostilled or legalised, in India. Our guide to NRI marriage registration covers registering such marriages.
Conditions under the Special Marriage Act
- Neither partner has a living spouse; a divorced partner must show the final decree.
- Both can give valid consent.
- The man has completed 21 and the woman 18. See legal age for marriage.
- They are not within prohibited degrees of relationship.
- Notice is given to the Marriage Officer of the district where at least one partner has lived for 30 days before the notice. This is why a foreign partner arriving shortly before the wedding usually relies on the Indian partner's residence, or the couple plans a longer stay.
After the 30-day notice period, the marriage is solemnised before the Marriage Officer and three witnesses.
Documents a foreign partner usually needs
Exact lists vary by district, so ask the Marriage Officer, but expect:
- Passport and a valid Indian visa. Registrars check that the visa is valid on the date of notice and of marriage.
- Proof of single status: a certificate of no impediment, single status certificate or no objection certificate from the foreign partner's embassy or home authority. If previously married, the divorce decree or spouse's death certificate.
- Proof of address in India and, where asked, evidence of 30 days' residence for whichever partner is the basis for notice. Some offices also ask for a police verification report.
- Affidavits on age, marital status, nationality and no prohibited relationship.
- Photographs and witness identity documents.
Foreign documents may need to be apostilled in the issuing country, or attested by the Indian mission, and translated into English. The Indian partner needs the usual documents for marriage registration.
After the wedding: visa for the foreign spouse
A foreign spouse of an Indian citizen, or of an OCI cardholder, can apply for an Entry (X) visa through the Indian mission, with the marriage certificate (apostilled or legalised if issued abroad). Indian missions state that an entry visa is generally issued for one year or less, and in some cases for longer. An entry visa does not permit employment. Those staying beyond 180 days usually need to register with the Foreigners Regional Registration Office. Nationals of some countries face separate rules, so read your mission's page.
OCI for a foreign spouse
Under section 7A(1)(d) of the Citizenship Act, 1955, a spouse of foreign origin of an Indian citizen or of an OCI cardholder can be registered as an Overseas Citizen of India if the marriage is registered and has subsisted for a continuous period of at least two years immediately before the application. Applicants go through prior security clearance and, at some missions, an interview with the spouse present. A person who is or was a citizen of Pakistan or Bangladesh, or whose parents, grandparents or great-grandparents were, is not eligible, and serving or retired members of foreign military, police or intelligence services are excluded. OCI is not citizenship and does not give voting rights.
A few cautions
- Register the marriage and get several certified copies; foreign immigration authorities and banks will ask for them.
- Think about where you will live and which country's courts would handle any later dispute. Our pages on NRI divorce and NRI matrimony explain why this matters.
- If an agent offers to "arrange" a quick marriage without notice or residence, be wary; it may not be valid.
