Marriage law · Before marriagePrenuptial Agreement in India: Is It Valid?
India has no general law that recognises prenuptial agreements, and courts treat them cautiously. Goa is the exception, where couples choose a property regime by deed before marriage. Here is what a prenup can and cannot do elsewhere.
The general position
A prenuptial agreement ("prenup") is a contract a couple signs before marriage setting out how property, money and sometimes maintenance will be handled if they separate. In much of the world it is routine. In India:
- No central law on marriage, such as the Hindu Marriage Act or the Special Marriage Act, provides for prenups.
- A prenup is therefore treated as an ordinary contract under the Indian Contract Act, 1872. Section 23 of that Act makes an agreement void if its object is against public policy. Courts have traditionally been wary of agreements that appear to plan for divorce or to give up rights the law grants a spouse.
- Rights given by statute, such as maintenance for a wife, children's maintenance and custody, cannot be bargained away. Courts decide these on the facts at the time, and on the child's welfare for custody.
So a prenup is not illegal to sign, but you should not assume a court will enforce it as written.
Goa: the one clear exception
Goa follows its own civil code, inherited from the Portuguese Civil Code of 1867 and continued after 1961 by Parliament. Under it:
- The default regime for a marriage is communion of assets: property owned by each spouse before marriage and acquired after it is, broadly, held in common, and each spouse has a half share.
- Couples can opt out by signing an antenuptial agreement as a public deed before the marriage, choosing a different regime, such as separation of assets.
- Reports of Goan practice say the regime chosen is fixed once the marriage takes place and cannot be changed afterwards.
This is why prenups are common and effective in Goa, and why couples marrying there should decide the regime before the wedding. See our Goa marriage registration guide for the registration steps.
How courts outside Goa have treated prenups
There is no Supreme Court ruling that sets out when a prenup is enforceable. Family courts have at times looked at such agreements as evidence of what the parties intended about property they brought into the marriage, while refusing to let them override statutory rights. Clauses that try to fix in advance the amount of maintenance, waive maintenance completely, or decide custody are the least likely to be upheld.
What couples can still document
Even without a dedicated law, writing things down can prevent disputes and help prove ownership later.
- List of pre-marriage assets. A signed schedule of property, investments, gold and loans each person owns before the wedding, ideally with documents attached.
- Stridhan record. Jewellery and gifts given to the bride are her own property (stridhan). A dated list with photographs is useful in any later dispute; see our page on dowry law for how stridhan differs from dowry.
- Ownership of a home. If one partner pays for a flat, a clear title deed and loan papers matter far more than any prenup.
- Business interests. A shareholders' or partnership agreement can say what happens to a family business stake.
- Muslim marriages. The nikahnama is itself a contract. It records the mahr and can include agreed conditions; such clauses are part of Muslim personal law, explained on our Muslim marriage law page.
Have the document drafted by a lawyer, signed well before the wedding, with full disclosure by both sides, independent advice for each, and witnesses. An agreement signed under pressure the night before the wedding is easy to attack.
Talking about it with your partner
Raising a prenup can feel awkward in an Indian family setting, where marriage is seen as joining two families. It can help to frame it as being clear and fair about what each of you brings, not as planning for failure. For couples where one partner lives abroad, the question also comes up because foreign courts may treat prenups differently; our NRI matrimony page and the guide to marriage with a foreign national touch on cross-border issues.
This page is general information, not legal advice. Laws and procedures change, and courts may read them differently in your facts. Are prenuptial agreements legal in India?
They are not illegal, but outside Goa there is no law that specifically recognises them. Courts treat them as ordinary contracts and will not enforce terms that are against public policy or that take away statutory rights.
Why are prenups valid in Goa?
Goa's civil code makes communion of assets the default for marriages and lets couples choose another regime, such as separation of assets, by a public deed signed before the wedding.
Can a prenup waive a wife's right to maintenance in India?
Courts are unlikely to accept that. Maintenance is a statutory right decided on the facts at the time of the claim, and agreements that give it up in advance are commonly treated as against public policy.
What should couples document before marriage if not a prenup?
A signed list of each person's pre-marriage assets and loans, a record of stridhan, clear title papers for property, and business agreements. These help prove ownership later.
