Marriage Registration in Goa: Civil Registrar, Two Stages

Goa is different from the rest of India. Marriages here are registered under the Portuguese-era civil registration system, whatever the couple's religion, and the registration before the Civil Registrar is itself the legal marriage.

Official portal: Goa Marriage Portal

Why Goa is different

When Goa joined India in 1961, its Portuguese-era family laws were kept in force. Among them is a civil registration system that governs marriages, births and deaths. The Goa Registration Department's citizen charter puts the result plainly: marriages are registered in Goa under the Code of Civil Registration irrespective of religion, and without registration, a marriage is not legally recognised in Goa.

That reverses the position elsewhere in India, where a religious ceremony creates the marriage and registration only records it. In Goa, the charter says, the date of registration is the date of the marriage for all legal purposes, whether or not religious ceremonies took place. In a 2019 judgment, Jose Paulo Coutinho v. Maria Luiza Valentina Pereira, the Supreme Court described Goa as a shining example of a state with a uniform civil code applying to all, regardless of religion.

Who registers

Each taluka has an office of the Civil Registrar-cum-Sub-Registrar, who also acts as Notary Ex-Officio, under the Registration Department. District Registrar offices for North and South Goa supervise them.

Conditions to marry

The charter summarises the main rules:

  • Impediments: set out in Articles 4 to 10 of the Goan marriage law (Law No. 1), covering relationship by blood or affinity, insanity and certain other grounds.
  • Age: the groom must have completed 21 years. A bride between 18 and 21 needs the consent of her parents (or grandparents or a family council if the parents are dead), or emancipation by a court. Parents can consent orally at the registration, or through a notarised special power of attorney if they are not in Goa.
  • Close relatives: a marriage within the third degree of collateral relationship, such as uncle and niece, needs the Governor's permission.
  • Remarriage: after a spouse's death or a divorce, there is a waiting period of six months for men and one year for women, with some exceptions, and none after a court annulment.

The two stages

Stage I: online application and declaration

  • Create an account on the Goa Marriage Portal (reg.goa.gov.in), enter details of the bride and groom, upload documents and photographs, and choose the office. The office must match the jurisdiction of your residence certificate.
  • The Civil Registrar's office scrutinises the application. Once it is cleared, you pay the fee and book an appointment for the declaration of intention to marry.
  • On that date the bride and groom appear in person (with both parents if the bride is under 21) and bring recent birth certificates of both, and a residence certificate showing continuous residence in Goa for more than one month before the declaration, issued by the Mamlatdar, Sarpanch, municipal Chief Officer or similar authority.

The waiting period

Between the two stages there is a statutory waiting period of 15 days, including two Sundays, while the notice is published so that anyone who knows of a legal impediment can object. In deserving cases the Assistant Public Prosecutor of the area can waive it.

Stage II: registration

The bride, the groom and two witnesses appear and sign, with the parents if the bride is between 18 and 21, and an interpreter or extra witness if advised. The marriage is then registered, and a certificate can be obtained from the office.

Catholic church weddings

A Roman Catholic couple marrying in church under canon law still completes the civil formalities. The charter tells them to collect the certificate from the Civil Registration office for the church, and afterwards to check personally that the record of the church marriage has reached the office.

Special cases

The charter lists extra requirements for a foreign partner (a court order), residence outside Goa for more than a year (an oath), one partner living outside Goa (an affidavit), proxy marriages (a special power of attorney) and ante-nuptial contracts, which are registered before the Special Notary. Without such a contract, Goan law generally treats the couple's property as held in common, which is why some couples sign one. See prenuptial agreements in India.

A Goan who marries outside India can record the marriage in Goa by transcription, within three months of the marriage or one month of either spouse first coming to Goa. See NRI marriage registration.

Fees in the department's charter

The citizen charter lists fees as on 1 April 2017, from the state gazette: Rs 500 to register a marriage of an Indian national (Rs 200 for SC/ST), and Rs 10,000 for a marriage involving a foreign national. Extra fees apply for a marriage outside the office or outside working hours. Check the portal for current amounts.

Corrections and cancellation

Errors are corrected through the Civil Registrar under Article 32, with witnesses and an order of the District Registrar. A registered marriage entry can be cancelled only on a court decree of annulment or divorce. Marriage records from 1914 to 2010 can be searched online. For other states, see the documents checklist.
