The 2006 Rules
The Chhattisgarh Compulsory Registration of Marriages Rules, 2006 were notified in the state gazette on 20 November 2006, following the Supreme Court's direction in Seema v. Ashwani Kumar that all states make marriage registration compulsory. The Rules state their purpose as restraining child marriage and protecting the rights of children born of the marriage.
The Rules cover every marriage solemnised in the state between a man and a woman, irrespective of religion or caste, whether performed under a statute, custom, practice or tradition, and they expressly include remarriages.
Who the Registrar is
The Rules make the local authority the Registrar for its area:
- the gram panchayat in villages;
- the municipality or municipal corporation in towns and cities.
A Chief Registrar for the state supervises the system, and the Registrar sends records of each registered marriage to the Chief Registrar. District information pages note a practical consequence: a gram panchayat registers only the marriages that took place in its own area.
Filing the memorandum (rule 4)
- The parties submit a memorandum in the form in Schedule A, in duplicate, to the Registrar of the area where the marriage was solemnised.
- It is due within 30 days of the marriage, delivered in person or sent by registered post.
- A Registrar can accept a late memorandum if the party shows they were prevented by a cause beyond their control. See registering a marriage after the wedding.
- The memorandum asks for the date of birth, age at marriage, residential address and status (unmarried, widowed or divorced) of each party, and whether the marriage has already been registered elsewhere.
The Registrar enters the marriage in the register and issues a certificate in the form in Schedule D.
When a Registrar can refuse
A Registrar can refuse registration, after hearing the parties and recording reasons in writing, if they believe the marriage was not performed in accordance with law or the parties' personal law, the identity of the parties or witnesses is not established, or the documents do not prove marital status. Before refusing, the Registrar can ask for more documents or send the papers to the local police station for verification.
Appeals (rules 5 and 6)
- To the Collector, or an officer nominated by the Collector, within 30 days of the refusal order.
- Then to the District Judge within 30 days of the Collector's order. The District Judge's decision is final.
Other points in the Rules
- Non-registration does not invalidate a marriage (rule 9).
- Employers need the certificate. Government bodies, companies, public sector undertakings and local authorities are not to change an employee's marital status or nomination in their records without a certified copy of a marriage registration certificate (rule 11).
- Wilfully failing to submit the memorandum, or giving false information, is punishable with a fine.
