Marriage Registration in Andaman and Nicobar Islands

In the Andaman and Nicobar Islands, marriages are registered by the Additional District Magistrate and Assistant Commissioners under the Hindu Marriage Act and the Special Marriage Act, with applications through the islands’ e-District service.

Official portal: South Andaman district: marriage registration

Two laws, one office

For years the islands’ officers were designated only as Marriage Officers under the Special Marriage Act, 1954, so marriages could not be registered under the Hindu Marriage Act at all. By a notification of 5 May 2022 under the Andaman and Nicobar Islands Hindu Marriage Registration Rules, 1958, the administration appointed Registrars of Hindu Marriages, replacing a 1958 notification. As reported at the time, they are:

  • the Additional District Magistrate, Port Blair, for South Andaman district;
  • the Assistant Commissioners at Diglipur, Mayabunder and Rangat for their tehsils;
  • the Assistant Commissioners for Car Nicobar, Nancowry and Campbell Bay.

Couples now choose between the Hindu Marriage Act and the Special Marriage Act depending on their religion and situation.

Which law fits your marriage

  • Hindu, Buddhist, Jain and Sikh couples who have already married by their own rites can register under the Hindu Marriage Act. The administration said registration under it would be done without delay, unlike the 30-day notice under the Special Marriage Act, for couples who have lived in the registrar’s area for at least 30 days. Members of Scheduled Tribes are outside the Act unless the Centre directs otherwise.
  • Any couple, including inter-religion couples, can marry before the Marriage Officer under the Special Marriage Act, or register an existing marriage under it. Both involve a 30-day notice for objections. See court marriage under the Special Marriage Act and inter-religion marriage registration.
  • Christian couples married in church can use the church’s certificate under the Indian Christian Marriage Act, 1872, or register under the Special Marriage Act. See Christian marriage law.

What the South Andaman office asks for

South Andaman district publishes three services: solemnisation under the Special Marriage Act, registration under the Special Marriage Act, and registration under the Hindu Marriage Act. Its requirements include:

  • both parties having stayed in the district for more than 30 days, with documentary proof;
  • proof of date of birth, such as the Class 10 certificate, passport or birth certificate;
  • self-attested address proof, such as Aadhaar, voter ID, Islander card, passport or driving licence;
  • affidavits from both parties on the date and place of marriage, date of birth, marital status and nationality, in formats the district provides;
  • passport-size photographs, a marriage photograph and the invitation card if available;
  • a certificate from the priest or religious authority if you married at a place of worship;
  • a divorce decree or death certificate where relevant;
  • originals at each appointment.

The page states different minimum ages for Special Marriage Act solemnisation (21 and 18) and registration (21 for both, which matches section 15 of that Act), so ask the office if you are unsure.

Applying

The South Andaman office directs applicants to the islands’ e-District portal. Outside South Andaman, apply to the Assistant Commissioner for your tehsil. If one of you lives on the mainland, plan around the 30-day residence condition. See the documents checklist.
