Marriage registration · AssamMarriage Registration in Assam: Sewa Setu and 2024 Act
In Assam, marriages are registered at Sub-Registrar offices under the Inspector General of Registration, with applications made online through the Sewa Setu portal. Since 2024, Muslim marriages and divorces have their own compulsory-registration law, run by the same government registrars.
Official portal: Sewa Setu Assam: marriage registration
Who registers marriages in Assam
Marriage registration in Assam is handled by the Sub-Registrar offices that work under the Inspector General of Registration (IGR), Assam. The IGR website carries the Hindu Marriage Act, 1955 and the Special Marriage Act, 1954, along with the procedure and fee pages for each, and lists every Sub-Registrar office in the state. District websites, such as Hailakandi's, list marriage registration among the services of their Sub-Registrar office.
Which law you use depends on who you are:
- If both partners are Hindu, Buddhist, Jain or Sikh, an already solemnised marriage can be registered under the Hindu Marriage Act. See Hindu Marriage Act registration.
- Any couple, including inter-religion couples, can marry before a Marriage Officer, or register an existing marriage, under the Special Marriage Act.
- Muslim marriages and divorces are registered under the Assam Compulsory Registration of Muslim Marriages and Divorces Act, 2024, explained below.
Applying through Sewa Setu
Assam's citizen-services portal, Sewa Setu, has an "Application for Marriage Registration" service, filed through the state's right-to-public-services (RTPS) system. As the service page describes it:
- You fill the application online, upload the supporting documents and pay the fee online.
- An acknowledgement with an RTPS number is generated after payment.
- The application is verified at the Sub-Registrar office.
- A marriage notice is displayed at the Sub-Registrar office and published on the RTPS portal.
- After 30 days from approval of the application, you can book an appointment online or visit the office.
- The couple appears before the Marriage Officer, the proceedings are completed and the certificate is handed over.
There is a separate Sewa Setu service for the Bodoland Territorial Area Districts, so pick the one for your district.
The public marriage notice board
Assam publishes notices of intended marriages under the Special Marriage Act on an online Marriage Notice Board on the RTPS site, where anyone with an objection can raise it. The Act allows objections only on its legal grounds, such as an existing spouse, age or prohibited relationship, not on grounds of family disapproval. If you fear threats because of the notice, you can approach the police or the courts for protection. The full sequence is in our guide to court marriage under the Special Marriage Act.
Muslim marriages: the 2024 Act
In August 2024 the Assam Legislative Assembly passed the Assam Compulsory Registration of Muslim Marriages and Divorces Bill, 2024, together with a repealing law that abolished the Assam Moslem Marriages and Divorces Registration Act, 1935. Under the 1935 Act, Muslim persons were licensed to register marriages and divorces. Under the 2024 Act, government registrars do this work instead. In practice the Sub-Registrar acts as Marriage and Divorce Registrar: a 2026 Gauhati High Court case concerned an order of the "Sub Registrar-cum-Marriage and Divorce Registrar" at Barpeta.
Key points of the 2024 Act, as reported when it was passed and applied by the High Court:
- It covers Muslim marriages solemnised in Assam, before or after it came into force, except marriages under the Special Marriage Act.
- The minimum ages are 21 for the man and 18 for the woman, with free consent of both. Marriages below those ages are not registered, and registrars must report child marriages to the Child Marriage Prohibition Officers.
- A notice is published and objections can be made within 30 days. The registrar can refuse registration but must record reasons in writing.
- Appeals lie to the District Registrar and then to the Registrar General of Marriage.
- Divorces are registered too. The Gauhati High Court has noted that an application to register a divorce under section 12 must be made within one month, with the parties present, and that a refusal can be challenged under the Act's grievance provision.
Background on the personal law is in our page on Muslim marriage law, and on age limits in child marriage law.
Documents
The Sewa Setu service asks for:
- identity proof of the bride and groom;
- address proof, such as voter ID, passport, bank passbook or Aadhaar;
- age proof, such as a birth certificate or HSLC admit card;
- for an intended marriage, the marriage notice signed by both parties;
- for a solemnised marriage, the signatures of both spouses.
Expect also to bring wedding proof and witnesses with identity proof. The general list is in our documents checklist.
Fees
The fee is shown on Sewa Setu when you apply, and IGR Assam publishes a registration fee structure on its website.
