Marriage registration · JharkhandMarriage Registration in Jharkhand: 2017 Act and JharSewa
Jharkhand has its own compulsory-registration law, the Jharkhand Compulsory Registration of Marriages Act, 2017, which uses the same local registrars who record births and deaths. Applications can be made online on JharSewa or on paper.
Official portal: JharSewa Jharkhand
Jharkhand's compulsory-registration law
The Jharkhand Compulsory Registration of Marriages Act, 2017 (Jharkhand Act 4 of 2018) is administered by the Revenue, Registration and Land Reforms Department. Its preface explains why it was passed: none of the existing marriage laws made registration compulsory, and compulsory registration was meant to curb child marriage and polygamy and strengthen the position of women.
The Act applies to marriages solemnised after it came into force where one or both parties are Indian citizens living in Jharkhand. It covers marriages under every personal law, including the Hindu Marriage Act, the Special Marriage Act, the Indian Christian Marriage Act, Muslim personal law, the Anand Marriage Act, the Parsi Marriage and Divorce Act and any other custom, and it includes remarriages.
Who registers
- Registrar General of Marriages for the state, to monitor the Act.
- Chief Registrar of Marriage: the Deputy Commissioner of each district.
- Registrar of Marriages: in towns, the officers of the municipal corporation, municipality, notified area committee or nagar parishad who register births and deaths; in villages, the officers who register births and deaths, such as Panchayat Sevaks.
A Registrar can register a marriage solemnised in their area, or one solemnised elsewhere if at least one partner lives in their area.
Conditions for registration (section 11)
- The bride has completed 18 years and the bridegroom 21 years.
- Neither has a living spouse, unless the personal law of the party specifically allows it.
- Neither is of unsound mind or incapable of valid consent, and they are not within the prohibited degrees.
- One party is an Indian citizen who lives in the Registrar's area, or the marriage was solemnised there.
How the application works (section 12)
- Apply online, or on paper in Form-I, to the Registrar of Marriages for your area. Common Service Centres and other authorised outlets can also take applications.
- Give details of both parties, including photographs, age, address, occupation, date and place of marriage, Aadhaar number and mobile number.
- Attach a certificate that the marriage took place: in rural areas from the Mukhiya or Sarpanch or a gazetted officer; in urban areas from the ward commissioner or a gazetted officer.
- Upload wedding photographs, the wedding card or a certificate from the priest or Kazi (or the Nikahnama, or an Anand Karaj certificate from a gurdwara), age proof, residence proof and Aadhaar.
- The Registrar has one month to point out defects or objections. If you hear nothing in that month, you appear before the Registrar with three witnesses.
- Documents are checked, photographs of the couple and witnesses are taken, and the certificate is generated online for download. The Act says two copies are issued free of cost.
Anyone wishing to object must file a written complaint online with an affidavit within 15 days of the application. Where one partner is an NRI or a foreign national, the Act requires passport and overseas address details, and the Registrar verifies a foreign partner's status with their embassy. See NRI marriage registration.
The one-year limit
The Act requires marriages to be registered within one year of the solemnisation, and offline memoranda are to be filed within the same period. Note too that section 21 says registration is proof of registration only, not proof that the marriage is valid under the personal law.
JharSewa and the Sub-Registrar
The state's e-district portal, JharSewa, lists a "Marriage Registration Certificate" service under the Department of Revenue. Its document list follows the Act, including the certificate from the Mukhiya, Sarpanch, ward commissioner or a gazetted officer, and the wedding card or a certificate from the priest or Kazi.
Separately, district registry offices, such as those in Simdega and Ramgarh, list marriage registration among the Sub-Registrar's services. This is the route for Hindu Marriage Act registrations under the state's Hindu marriage rules and for the Special Marriage Act. See court marriage under the Special Marriage Act and the documents checklist.
Fees
The fee, and any late fee prescribed by the state, is shown when you apply on JharSewa.
