Marriage Registration in Tripura: Recording of Marriage Act

Tripura records marriages under its own law, the Tripura Recording of Marriage Act, 2003, through Sub-Divisional Marriage Recorders, and the certificate can be applied for on the state e-District portal.

The 2003 Act

The Tripura Recording of Marriage Act, 2003 (Tripura Act No. 22 of 2004) came into force on 1 October 2004 and was amended in 2013. It extends to the whole of Tripura. Section 3 requires all marriages solemnised in the state after it came into force, in any form recognised under the personal law or custom of the husband and wife or either of them, to be recorded. That covers Hindu, Muslim and Christian marriages as well as marriages performed under the customs of the state’s tribal communities.

Who records marriages

  • A Chief Marriage Recorder for the state.
  • A District Marriage Recorder for each revenue district, and Sub-Divisional Marriage Recorders, in practice the SDM offices.
  • Marriage Reporters for each municipality, each panchayat, and Tehsil areas without either. The Tehsildar has been appointed Marriage Reporter for such Tehsil areas.

Recorders and reporters are to work without fee or reward when receiving information.

How recording works

Under section 7, within 60 days of the marriage the husband (if adult) must, and the wife may, either inform the Sub-Divisional Marriage Recorder or Marriage Reporter orally, or prepare and sign a memorandum in Form A with the signatures or thumb impressions of both spouses and two witnesses of the locality, and deliver it in person or by registered post. Where either spouse was a minor, the duty falls on the parent or guardian who consented; child marriage remains an offence, and our page on child marriage law explains the national law.

The officer gives an acknowledgement, verifies the details and enters them in the register. A memorandum cannot be refused because the marriage took place outside the officer’s area. Registrars under the Christian, Parsi, Special and Hindu marriage laws also send their register extracts to the Sub-Divisional Marriage Recorder, so those marriages appear in the state record too.

Late and older marriages

  • After 60 days: section 8 still allows recording, on payment of an amount set by the rules.
  • Before October 2004: the 2013 amendment added section 7A, letting couples married before the Act, whose marriage is not registered under any other law, record it voluntarily with no 60-day limit.

Section 10 says no marriage is invalid only because it was not recorded, and section 13 says a recorded marriage is presumed valid unless the contrary is proved. The certificate is issued in Form C. The 2013 amendment also made a knowingly false statement in Form A punishable.
