Marriage Registration in Himachal Pradesh: 1996 Act

Himachal Pradesh was one of the first states with a compulsory-registration law. Under the Himachal Pradesh Registration of Marriages Act, 1996, every marriage contracted in the state is to be registered, and applications are now made on the state e-District portal.

Himachal Pradesh's own law

The Himachal Pradesh Registration of Marriages Act, 1996 (Act 21 of 1997) received the President's assent on 22 September 1997. When the Supreme Court ordered compulsory registration across India in Seema v. Ashwani Kumar in 2006, it noted Himachal Pradesh as one of only four states that already had such a law.

The Act sets up three levels of authority:

  • a Chief Registrar of Marriages for the state;
  • a District Registrar of Marriages for each revenue district;
  • a Registrar of Marriages for each local area, which can be a tehsil, a municipal corporation or municipality, a cantonment board or another local authority. In local bodies, the state can appoint one of their officers as Registrar.

Every marriage is to be registered

Section 6 says every marriage contracted in Himachal Pradesh is to be registered in the manner set out in section 7. It applies whatever the religion of the couple and alongside the personal law under which the marriage was solemnised.

The memorandum (section 7)

  • The parties to the marriage prepare and sign a memorandum in the form in the Act's Schedule. If a party has not completed 21 years, the father or guardian does so, unless the marriage took place without their consent, in which case the party signs.
  • The memorandum is also signed by the officiating priest, if any. For a marriage before a Marriage Officer, it is supported by certified copies of the Marriage Certificate Book entries.
  • It is delivered or sent by registered post, in duplicate, to the Registrar of Marriages within 30 days of the marriage.

Where to register (section 9)

Registration is done at the office of the Registrar where the marriage was solemnised, or where either or both parties have their permanent residence. The Act also allows registration at a place outside the office on a written application and an additional fee.

Late registration (section 8)

  • After 30 days: a memorandum can still be filed, with a late fee.
  • After 90 days but within one year: only with the written permission of the prescribed authority, on the prescribed fee and an affidavit before a notary or an authorised officer.
  • After one year: only on an order of a Magistrate after verifying that the marriage took place. A 2006 amendment defines Magistrate here as an Executive Magistrate.

Section 12 is important for anyone who is late: no marriage is invalid only because it was not registered or the memorandum was defective. See registering a marriage after the wedding.

Marriages abroad (section 11)

If a marriage was solemnised in a foreign country between parties of whom at least one was an Indian citizen, the Chief Registrar can register it on a memorandum and a certificate from the Indian consulate, provided the conditions of the Foreign Marriage Act, 1969 are met. A party returning to settle in India can register within 60 days of arrival as if the marriage had taken place in India. See NRI marriage registration.

Applying on e-District

The state's checklist for the marriage certificate service directs applicants to the Himachal Pradesh e-District portal, where the service sits under the Panchayati Raj or Urban Development link in "More Services". You sign up, log in and apply online.

  • Rural applicants: where the application is made more than 90 days after the marriage, the SDM or Deputy Commissioner approves, rejects or verifies it.
  • Urban applicants: the Registrar approves, rejects or sends the application back with a query.

The checklist asks for residence proof, a certificate from the priest who solemnised the marriage, affidavits from the bride and the bridegroom, age proof of both, the marriage card and the memorandum of marriage. Our documents checklist has the general list.

Special Marriage Act

Couples of different religions, or anyone choosing a civil marriage, can use the Special Marriage Act, 1954 before the Marriage Officer of the district, with 30 days residence before notice and a 30-day objection period. Ask the Deputy Commissioner's office which officer acts as Marriage Officer in your district.
