Marriage registration · SikkimMarriage Registration in Sikkim: 371F, Old Laws and SMA
Sikkim’s marriage law is a mix of laws kept in force from before 1975, under Article 371F, and central Acts extended later by presidential notification. Registration is handled by the district and sub-divisional administration.
Why Sikkim is different
When Sikkim became a state in 1975, Article 371F(k) kept in force all laws that applied in its territory before the appointed day until a competent legislature or authority amends or repeals them. Article 371F(n) lets the President extend, by notification, any law in force in another state to Sikkim, with restrictions or modifications. That is why some central marriage laws reached Sikkim only recently, and why older Sikkim rules still matter.
The 1963 Form of Marriage rules
Sikkim has long had rules for the registration and solemnisation of a Form of Marriage in Sikkim (1963). The Supreme Court referred to them in Amanjot Singh Chadha v. Union of India in September 2025, when it directed that Anand Karaj applications be processed under those existing rules until the Anand Marriage Act was extended. District offices also list services under Hindu Marriage (Sikkim) Rules. North Sikkim’s district page, for example, lists that service at the Additional District Collector or SDM’s office in Mangan, with an application form, photographs, birth certificates, a residence or Certificate of Identification document, a panchayat report and police verification.
Special Marriage Act, from 2019
By a Home Ministry notification of 9 October 2019, the President extended the Special Marriage Act, 1954 to Sikkim under Article 371F(n). References to laws or officers that do not exist in Sikkim are read as the corresponding ones there, and the Act commences on dates the Centre notifies, possibly by area. This gives inter-religion and inter-community couples a civil route. See court marriage under the Special Marriage Act and inter-religion marriage registration.
Anand Karaj marriages, from 2026
Following the 2025 judgment, the Sikkim Land Revenue and Disaster Management Department published the Sikkim Anand Marriage Registration Rules, 2026 in March 2026, and the Union notified the Anand Marriage Act, 1909 for Sikkim with effect from 1 June 2026, as reported. Sikh couples married by Anand Karaj can now register under that Act. See Anand Karaj and Sikh marriage.
Where to apply
Marriage certificates are issued by the district administration, usually the SDM or Additional District Collector. Some offices ask for a panchayat report and police verification, so allow time. The state’s single sign-on portal has been reported to list an online marriage certificate service; we could not open it, so check with the office first.
