Marriage Registration in Maharashtra: 1998 Act and SMA

Maharashtra has its own compulsory-registration law, the Maharashtra Regulation of Marriage Bureaus and Registration of Marriages Act, 1998, handled mostly by municipal and village registrars, while Special Marriage Act notices go through the IGR department online.

Maharashtra's own law

The Maharashtra Regulation of Marriage Bureaus and Registration of Marriages Act, 1998 does two things that its long title describes: it regulates marriage bureaus to prevent malpractice, and it makes registration of marriages compulsory in the state. It is supported by rules made in 1999. Couples who married in Maharashtra under their personal law, whether Hindu, Muslim, Christian or any other, register under this Act.

The 90-day memorandum

Under section 6 of the Act, it is the husband's responsibility to present a memorandum of marriage in the prescribed form, within 90 days of the solemnisation, to the Registrar of the area where he or either party ordinarily resides. The parties and three witnesses appear in person and sign, and the Registrar verifies identities before entering the marriage in the register and issuing a certificate.

A marriage not registered within 90 days can still be registered under the Act on payment of a penalty, through the Registrar where the parties ordinarily reside. Beyond the window set in the Act, ask the Registrar about the procedure. See registering a marriage after the wedding.

Who the Registrar is

In practice the Registrar under the 1998 Act is a local-body officer:

  • Cities: the municipal corporation, usually at the ward office covering your address. Mumbai's and Vasai-Virar's corporations, for example, register marriages at ward level.
  • Villages: the state's Aaple Sarkar portal lists a marriage certificate service with the Gram Sevak as the designated officer and the Block Development Office as the appellate level. The portal notes some of these services are moving to the MAITRI portal.

An official Aaple Sarkar flowchart for the 1998 Act and 1999 Rules shows the application going to the Registrar at the bride's or groom's place of residence, fees paid online, and an appeal route to a state-level registrar if registration is refused.

Special Marriage Act in Maharashtra

Court marriages and section 15 registrations under the Special Marriage Act, 1954 are handled by the Department of Registration and Stamps (IGR), where Sub-Registrars act as Marriage Officers. The IGR online notice system:

  • requires at least one party to have lived in the Marriage Officer's district for 30 days before the notice;
  • uses Aadhaar verification and online payment of the notice fee;
  • sends the application to the Sub-Registrar office for approval; if the Marriage Officer raises a query and it is not answered within 15 days, the application can be rejected automatically.

Some districts are directed to the newer Marriage Registration 2.0 system instead, so follow the instructions on the IGR page for your district. The full procedure is in our court marriage guide.

Points specific to Maharashtra

  • Municipal offices have stated that a marriage between partners of different religions cannot be registered on the 1998 Act form without conversion; such couples generally use the Special Marriage Act. See inter-religion marriage registration.
  • In 2017 the Bombay High Court quashed a circular that required the priest who performed the ceremony to be present at registration, because the Act provides only for the parties and three witnesses.

Documents

Expect the memorandum, age and address proof of both spouses, wedding proof such as the invitation card and photographs, and identity proof of three witnesses. The IGR department publishes checklists and forms on its marriage registration page.
